When Gov. Abbott passed the bill legalizing CBD and Hemp in Texas with up to .30% THC, it setup of a domino effect across multiple aspects of the issue. One thing that was not addressed was the fact that Texas Crime Lab computers do not distinguish between the quantity of THC in a flower, they just identify if it contains THC or not. This puts hundreds of cases in jeopardy across Harris County and other Texas municipalities as they struggle to find funding for the new type of testing that would be required to prosecute Marijuana crimes.
Last year nearly 70K misdemeanor marijuana cases where prosecuted in Texas that would require this additional type of testing. An estimated 35 million dollar impact to the budgets of state law enforcement agencies is substantial and could expedite the decriminalization of small amounts of marijuana across the entire state of Texas.
